As part of the proposed amendments to the Labor Code of the Republic of Kazakhstan, a new Article 197-1, \u201cPreventive Control Without Visiting the Subject (Object) of Control,\u201d is planned to be introduced.<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>What is the new mechanism?<\/strong><\/h3>\n<p>The new provision is being developed in accordance with the approaches set out in the Entrepreneurial Code of the Republic of Kazakhstan and is aimed at further developing a preventive model of state supervision. The main objective of the initiative is to prevent violations of labor legislation at an early stage without conducting on-site inspections. Control measures will be carried out remotely through the analysis of data contained in state information systems and information obtained through interagency data exchange.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<h3><strong>How will preventive control work?<\/strong><\/h3>\n<p>If a state labor inspector identifies clear signs of violations of employees\u2019 labor rights based on available data, they may conduct preventive control without visiting the employer. Following such control, the employer will receive recommendations for eliminating the identified violations. The proposed mechanism provides employers with the opportunity to voluntarily correct the situation. If the violation is remedied within 10 days, no additional control measures will be taken. However, if the identified violation is not eliminated within the specified period, the state labor inspector will be entitled to initiate an inspection involving a visit to the subject of control.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<h3><strong>What benefits will employers receive?<\/strong><\/h3>\n<p>The introduction of the new mechanism will shift the focus of state supervision from punishment to prevention.
