It became the first comprehensive legislative act regulating the digital environment, digital data, artificial intelligence, digital rights of citizens, electronic identification, and the activities of participants in the digital economy. At the same time, a number of subordinate regulations were adopted, establishing the procedures for the operation of digital data exchange platforms, the formation of digital data products, and the maintenance of the state register of such platforms. The new regulations affect government agencies, quasi-public sector entities, IT companies, digital platform operators, developers of digital solutions, owners of information systems, financial institutions, and businesses using digital technologies in their operations.<\/p>\n<p>&nbsp;<\/p>\n<h3>Key Objectives of the New Digital Code<\/h3>\n<p>The Digital Code establishes a unified legal framework for the country&#8217;s digital development and defines:<\/p>\n<ol>\n<li>the objectives, principles, and key directions of digital legislation;<\/li>\n<li>government regulation of the digital environment;<\/li>\n<li>the legal status of digital data and digital data products;<\/li>\n<li>the rights and obligations of participants in the digital environment;<\/li>\n<li>the rules governing the use of electronic digital signatures (EDS) and digital identification;<\/li>\n<li>the digital transformation of government activities;<\/li>\n<li>the foundations for the development of the state&#8217;s digital architecture.<\/li>\n<\/ol>\n<p>The primary objective of the Code is to ensure the safe, transparent, and consistent development of Kazakhstan&#8217;s digital economy.<\/p>\n<p>&nbsp;<\/p>\n<h3>Digital Rights of Citizens Introduced for the First Time<\/h3>\n<p>One of the most significant innovations is the legislative recognition of digital human rights.<\/p>\n<p>Citizens are now guaranteed the right to:<\/p>\n<ul>\n<li>~ request the deletion of personal data;<\/li>\n<li>~ request the anonymization of information;<\/li>\n<li>~ restrict the processing of their personal data;<\/li>\n<li>~ receive protection of their digital rights when using public and private digital services.<\/li>\n<\/ul>\n<p>Particular attention is given to biometric identification. Its use is permitted only in cases expressly provided for by the legislation of the Republic of Kazakhstan.<\/p>\n<p>&nbsp;<\/p>\n<h3>Right to Review Decisions Made by Artificial Intelligence<\/h3>\n<p>The Digital Code introduces an important safeguard for protecting citizens&#8217; rights when automated systems are used. If a decision made by an algorithm or an artificial intelligence system affects a person&#8217;s rights or legitimate interests, the individual has the right to request a review of that decision with the participation of authorized specialists. This approach is intended to increase the transparency, objectivity, and accountability of digital decision-making.<\/p>\n<p>&nbsp;<\/p>\n<h3>New Types of Digital Documents<\/h3>\n<p>The Code significantly expands the legal regulation of digital interaction. In addition to electronic documents, the legislation introduces the following concepts:<\/p>\n<ol>\n<li>digital document;<\/li>\n<li>digital information;<\/li>\n<li>digital confirmation.<\/li>\n<\/ol>\n<p>Digital confirmations may include:<\/p>\n<ol>\n<li>one-time identifiers;<\/li>\n<li>special digital codes;<\/li>\n<li>push notifications;<\/li>\n<li>biometric identification.<\/li>\n<\/ol>\n<p>This will expand the use of fully digital procedures in the provision of public and commercial services.<\/p>\n<p>&nbsp;<\/p>\n<h3>Development of Digital Data Exchange Platforms<\/h3>\n<p>One of the key elements of the digital economy is the establishment of digital data exchange and circulation platforms. These platforms provide:<\/p>\n<ul>\n<li>~ secure exchange of digital data;<\/li>\n<li>~ transparent conditions for data usage;<\/li>\n<li>~ standardized interaction among market participants;<\/li>\n<li>~ development of digital services and analytical solutions.<\/li>\n<\/ul>\n<p>Such platforms may be established by government agencies, state legal entities, quasi-public sector entities, and private businesses. When starting or terminating the operation of a platform, its owner must notify the authorized government body within five working days. If such notification is not submitted, the authorized body is entitled to monitor the platform&#8217;s activities.<\/p>\n<p>&nbsp;<\/p>\n<h3>Restrictions for Platform Owners<\/h3>\n<p>The new Rules establish several mandatory requirements. Owners and operators of platforms are prohibited from:<\/p>\n<ol>\n<li>circulating raw (unprocessed) data, including personal data;<\/li>\n<li>placing or storing digital data products outside the territory of the Republic of Kazakhstan;<\/li>\n<li>transferring digital data products to third parties without the consent of their owner.<\/li>\n<\/ol>\n<p>These requirements are intended to enhance information security and prevent the unlawful use of data.<\/p>\n<p>&nbsp;<\/p>\n<h3>Requirements for Digital Data Products<\/h3>\n<p>Digital data products must comply with the criteria established by law. They must:<\/p>\n<ol>\n<li>not contain personal data that allows direct or indirect identification of individuals;<\/li>\n<li>be processed and structured in accordance with security requirements;<\/li>\n<li>contain a complete set of metadata regarding their composition, structure, purpose, and conditions of use.<\/li>\n<\/ol>\n<p>Suppliers of digital data products are responsible for ensuring:<\/p>\n<ol>\n<li>completeness of information;<\/li>\n<li>accuracy of data;<\/li>\n<li>relevance of information;<\/li>\n<li>compliance of the product with its declared characteristics.<\/li>\n<\/ol>\n<p>Publicly available information provided for by the legislation of the Republic of Kazakhstan may not be sold, transferred, or otherwise alienated and may only be published for informational purposes.<\/p>\n<p>&nbsp;<\/p>\n<h3>State Register of Digital Platforms Established<\/h3>\n<p>As of 12 July, the Rules governing the State Register of Digital Data Exchange and Circulation Platforms also entered into force. The Register is maintained electronically in the Kazakh and Russian languages by the authorized body responsible for the development of the data economy. The Register is intended to:<\/p>\n<ol>\n<li>record digital platforms;<\/li>\n<li>systematize information;<\/li>\n<li>monitor platform activities;<\/li>\n<li>ensure the accuracy of information about platform owners and digital data products.<\/li>\n<\/ol>\n<p>A platform is included in the Register based on the submission of the relevant notification. The decision to include a platform in the Register is made within three working days.<\/p>\n<p>&nbsp;<\/p>\n<h3>What This Means for Businesses<\/h3>\n<p>The introduction of the Digital Code significantly increases compliance requirements for companies using digital technologies and processing data.
