Confirmation of Specialized Knowledge When Hiring
Amendments are planned to the Labor Code of the Republic of Kazakhstan dated November 23, 2015, aimed at improving the system of technical and vocational education. The changes will also affect the procedure for concluding an employment contract, in particular the list of documents that an employer is entitled to request from a candidate.
What Changes Are Proposed to Article 32 of the Labor Code of the RK
According to the planned amendments to Article 32 of the Labor Code of the Republic of Kazakhstan (documents required to conclude an employment contract), employers may be allowed to additionally request:
- a document confirming the recognition of professional qualifications (if available);
- a document confirming the availability of specialized knowledge or professional training, retraining.
This expands the employer’s ability to verify that a candidate meets the requirements of a specific position, profession, or type of work.
How «Specialized Knowledge» Is Planned to Be Defined in the Labor Code
The amendments propose defining specialized knowledge as a set of theoretical and practical knowledge in a specific professional field obtained as a result of: professional education, training, retraining, or practical work experience, and required for the proper performance of job duties for a specific position, profession, or type of work.
According to the developers, such changes will allow employers to ensure that a candidate truly possesses the necessary knowledge and skills, especially in positions where confirmed competencies and relevant professional training are essential.
