Stricter control over labor contracts: penalties for violations starting March 12

Control over the registration of labor contracts in the Unified System for Recording Labor Contracts (USRLC) is being strengthened in Kazakhstan. Employers must verify and submit all data on labor relations to the HR Enbek system by March 12, 2026.

The new requirements are related to amendments in Kazakhstan’s labor legislation and are aimed at increasing transparency in HR recordkeeping and ensuring the protection of employees’ rights. The Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan reminds employers that proper HR recordkeeping and registration of labor contracts in state systems are becoming mandatory requirements.

Penalties for violations in labor contract registration

Starting from March 2026, amendments to the Code of Administrative Offenses of the Republic of Kazakhstan come into force, introducing liability for untimely submission of data to USRLC.

According to Article 98 of the Code of Administrative Offenses, employers may face administrative liability for:

  • late registration of a labor contract;
  • absence of information about the conclusion of a labor contract;
  • failure to submit information on the termination of labor relations;
  • absence of data on amendments and additions to a labor contract.

Thus, the registration of labor contracts in HR Enbek becomes a key element in complying with Kazakhstan’s labor legislation.

HR Enbek helps employers identify errors

To reduce the risk of violations, employers can use the functionality of the HR Enbek portal, which allows them to monitor the accuracy of HR data.

The system automatically:

  • detects discrepancies related to employees;
  • sends notifications to the employer;
  • helps promptly correct errors in HR records.

This allows companies to timely adjust information related to labor contracts and HR documentation.

New monitoring tool — “Employee Discrepancies”

The “Employee Discrepancies” monitoring dashboard is also available on the HR Enbek portal.

It allows employers to:

  • check the accuracy of employee data;
  • track the registration of labor contracts;
  • monitor the payment of mandatory pension contributions.

The dashboard database is updated monthly, enabling employers to promptly detect and correct inconsistencies.

What employers need to do before March 12

Due to stricter requirements, employers are advised to verify HR data in advance and ensure compliance with legislation.

Employers should:

  • check the registration of all labor contracts in USRLC;
  • submit information on the conclusion and termination of labor contracts;
  • update information on changes in labor relations;
  • verify the accuracy of HR records.

Timely compliance with these requirements will help employers avoid penalties and ensure compliance with Kazakhstan’s labor legislation.

Digitalization of HR records in Kazakhstan

The tightening of control over labor contract registration is part of the broader digitalization of HR administration and labor relations in Kazakhstan.

The use of systems such as HR Enbek and USRLC allows the government to improve transparency in labor relations and better protect employees’ rights. For businesses, this means the need for more careful HR recordkeeping and timely registration of all changes in labor contracts.
