Changes in Labor Legislation 2026: Strengthened Data Control in Enbek

 Starting from March 2026, legislative amendments aimed at increasing transparency in HR record-keeping and strengthening labor discipline will come into force in Kazakhstan. The Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan reminds employers of the strict requirement to properly submit data to the Unified System for Employment Contracts Registration (USECR).

 

What Will Change?

In accordance with Article 98 of the Code of Administrative Offenses of the Republic of Kazakhstan, administrative liability is established for:

  • violation of the procedure for entering data on the conclusion of an employment contract;
  • late submission of information on the termination of an employment contract;
  • failure to record amendments and additions to employment contracts.

Control will now be strengthened through automated data reconciliation.

 

New HR Enbek Functionality

To facilitate business adaptation to the new requirements, the Ministry recommends using the proactive functionality of the HR Enbek Labor Resources Portal.

The system automatically detects discrepancies between employment contract data and mandatory pension contributions (MPC), sends notifications to the employer’s personal account and generates a monthly database to monitor data accuracy.

Additionally, an interactive monitoring dashboard titled “Employee Discrepancies” has been launched in the “Employees” section of the portal. It allows employers to track in real time:

  • the accuracy of employment contract records;
  • the completeness of mandatory pension contributions;
  • potential violations before inspections occur.
