Labour Code 2026: Key Changes
On November 19, 2025, the Mazhilis approved in the first reading a large package of amendments to the Labour Code of the Republic of Kazakhstan. These initiatives aim to improve working conditions, strengthen workplace safety requirements, and expand employee protections. The updates are considered some of the most significant in recent years, making it essential for businesses to understand their impact on HR processes and personnel documentation.
Strengthening Employee Rights and New Employer Obligations
The updated Labour Code introduces a new principle — the employee’s right to respect and protection of dignity. The list of mandatory employer acts is also expanded, requiring a more structured and formalized approach to HR management.
Local executive bodies will receive additional powers in the field of social partnership, strengthening oversight and interaction between the state, employers, and employees.
New Rules for Extending Fixed-Term Employment Contracts
The amendments significantly update the rules for extending fixed-term contracts:
- if a contract expires during sick leave or social leave, it is automatically extended;
- small businesses will be able to extend fixed-term contracts an unlimited number of times;
- contracts of company executives will remain valid until the founders appoint a new executive;
- additional guarantees are introduced for pregnant women and parents with children under three years old.
These updates require more careful HR monitoring, timely employee notifications, and accurate documentation.
Written Notifications and New Dismissal Requirements
Employers must now notify employees in writing about changes in working conditions. Additional regulations on dismissal procedures are also introduced, including compliance with notification deadlines and legal documentation standards.
Study Leave: Up to Six Months
The updated Labour Code introduces study leaves lasting up to six months. The employee retains their workplace, and in some cases, their average salary. This supports professional development but increases HR administrative responsibilities.
Workplace Safety: Higher Requirements and Expanded Powers for Inspectors
Employers will be required to modernize equipment and infrastructure to meet new safety standards.
Technical labour inspectors will receive:
- legally established authority,
- the right to participate in accident investigations,
- the right to file lawsuits in defense of workers.
This will require companies to revise internal regulations, training programs, and occupational safety systems.
