Procedure for Writing Off Penalties and Fines for Micro and Small Businesses
The Ministry of Finance of the Republic of Kazakhstan has approved the Rules for writing off penalties and fines for micro and small business entities. The document was registered with the Ministry of Justice on February 13, 2026 (No. 37975).
This measure is aimed at reducing the financial burden on entrepreneurs and provides an opportunity to settle tax arrears without additional sanctions.
Who Can Benefit from the Support Measure?
The right to have penalties and fines written off is granted to micro and small business entities, provided they fully repay the principal amount of tax arrears outstanding as of January 1, 2026.
The principal debt must be repaid between January 1 and March 31, 2026.
What Will Be Written Off
Upon full repayment of the principal amount of the debt:
- all accrued penalties will be written off, including penalties accrued up to the date of full payment;
- fines related to the taxes and mandatory payments for which the debt has been repaid will be written off;
- fines for turnover carried out before January 1, 2026 during the period of non-registration for VAT may also be written off, provided that no enforcement measures were applied as of January 1, 2026.
How the Write-Off Process Works
To qualify for the write-off, the entrepreneur must fully repay the principal debt by March 31, 2026.
After payment, the write-off of penalties and fines will be carried out following a review of taxpayer accounts by special commissions under the state revenue authorities.
