Strengthening the Protection of Workers’ Labor Rights in Kazakhstan

The Mazhilis of the Parliament of the Republic of Kazakhstan has adopted, in the second reading, a draft law aimed at improving occupational safety, strengthening the protection of workers’ labor rights, and developing the social security system. The initiative was proposed by Members of Parliament. The amendments were approved in the first reading on October 19, 2025.

 

Ban on the Substitution of Employment Relationships with Civil Law Contracts

One of the key provisions of the law is the prohibition of concluding civil law contracts (CLC) with individuals if at least one sign of an employment relationship is present. This measure is intended to prevent the substitution of labor relations and to ensure that employees receive the full range of labor and social guarantees.

 

New Requirements for Collective Agreements and Occupational Safety

The law supplements the content of collective agreements with mandatory conditions, including:

  • an acceptable ratio between the maximum and minimum wage levels for relevant professions and positions;
  • provisions on the payment of benefits and compensations, including those related to occupational accidents.

In addition, the authorized healthcare body is granted the authority to approve rules for determining the severity of occupational injuries.

The procedure for involving and engaging a mediator in the work of conciliation commissions in labor disputes is also clarified. The direct subordination of occupational safety and health specialists to the head of the organization is established, strengthening personal responsibility for ensuring safe working conditions.

 

Accounting for Childcare Leave of Non-Working Fathers in Pension Calculation

As part of the adopted law, amendments are introduced to the Social Code providing that the period of actual childcare for young children will be included in the employment record of non-working fathers when calculating old-age pension benefits. This norm implements a regulatory resolution of the Constitutional Court and is aimed at ensuring gender equality in the social sphere.

Additional Powers of Maslikhats

The competence of maslikhats is also expanded, granting them the authority to develop and approve rules for awarding the title of “Honorary Citizen of a Region, City, or District” based on standard regulations.

The adopted changes are aimed at increasing social protection of workers, developing fair labor relations, and strengthening the occupational safety system in Kazakhstan.
