Form 250.00 in Kazakhstan: Categories, Deadlines and Types of Declarations

When completing the Declaration of Assets and Liabilities (Form 250.00), it is important to correctly determine the taxpayer category, the reporting date for assets and liabilities, and the type of declaration to be submitted. These parameters depend on the declarant’s status and the grounds for the declaration requirement. Kazakhstan’s tax legislation establishes specific rules for candidates for certain positions, prospective major shareholders of financial institutions, and other individuals required to submit Form 250.00. This article outlines the procedure for completing the key sections of the declaration and the applicable submission deadlines.

Taxpayer Categories in Form 250.00

Form 250.00 includes a section titled “Select Taxpayer Category,” where one of three categories—A, B, or C—must be selected. The selected category determines the date as of which information on assets and liabilities must be reported.

Category A — Candidates for Certain Positions and Their Spouses

This category includes candidates for elected and public office positions, as well as positions involving the performance of government functions or functions equivalent to them, and their spouses.

The reporting date is determined as follows:

  1. Candidates for elected positions and their spouses must report information as of the first day of the month in which the nomination period begins.
  2. Candidates for public office positions and their spouses must report information as of the first day of the month in which the declaration is submitted.

Category B — Prospective Major Shareholders of Financial Institutions and Their Spouses

This category applies to individuals intending to become major shareholders of a bank, an insurance or reinsurance organization, or an investment portfolio management organization, as well as their spouses. For this category, information on assets and liabilities must be reported as of the first day of the month in which the declaration is submitted.

Category C — Other Individuals Required to Submit Form 250.00

This category includes other individuals subject to the obligation to submit a Declaration of Assets and Liabilities. Under Article 422(1) of the Tax Code of the Republic of Kazakhstan, information must be reported as of December 31 of the year preceding the year of submission. For example, if the obligation to submit Form 250.00 arises in 2026, assets and liabilities must be reported as of December 31, 2025. The list of individuals required to submit the declaration is established by Article 422(2) of the Tax Code of the Republic of Kazakhstan.

Deadlines for Submitting Form 250.00

For taxpayers falling under Category C, the declaration must be submitted no later than September 15 of the year in which the reporting obligation arises. This requirement is established by Article 424 of the Tax Code of the Republic of Kazakhstan. However, this deadline does not apply to candidates for the relevant positions or individuals intending to become major shareholders of financial institutions. Separate submission rules apply to these individuals based on their status. Therefore, when determining the deadline for submitting Form 250.00, taxpayers must consider both the year in which the reporting obligation arises and their taxpayer category.

Types of Form 250.00: Initial, Regular, and Supplementary Declarations

In addition to selecting the taxpayer category and reporting date, it is important to correctly identify the type of Form 250.00 being submitted. As a general rule, the Declaration of Assets and Liabilities is submitted only once. However, Article 422(6) of the Tax Code provides for cases in which the declaration must be submitted again, including certain categories of declarants and situations requiring corrections to previously reported information.

The following types of declarations are available:

  1. Initial declaration — submitted when the obligation to declare assets and liabilities arises for the first time.
  2. Regular declaration — submitted by candidates for the relevant positions and prospective major shareholders of financial institutions who have previously filed an initial declaration.
  3. Supplementary declaration — submitted when amendments or additions must be made to a previously filed declaration.
  4. Supplementary declaration in response to a notification — submitted to make corrections following violations identified by the state revenue authorities as a result of desk audits.

The notification number and date must be indicated only when submitting a supplementary declaration in response to a notification. Selecting the correct declaration type ensures that the nature of the reported information is properly identified and reduces the risk of errors when completing the relevant sections of the form.

Key Considerations When Completing Form 250.00

When preparing the Declaration of Assets and Liabilities, it is important to determine the declarant’s status and the applicable legal requirements. The first step is to identify the appropriate taxpayer category. The declarant must then determine the reporting date for assets and liabilities, verify the applicable submission deadline, and select the correct declaration type. Particular attention should be paid to situations involving repeated submissions or corrections to previously reported information. In such cases, it is essential to distinguish between regular and supplementary declarations, as the grounds for submitting them differ. Following the established procedure for completing Form 250.00 ensures that assets and liabilities are declared correctly in accordance with Kazakhstan’s tax legislation.
