HR Enbek: Notifications on Mandatory Employee Accident Insurance
The Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan has clarified the procedure for generating notifications on the HR Enbek portal regarding mandatory insurance of employees against accidents occurring in the course of their employment (official) duties. Such notifications are sent to employers when the system detects that information about a valid insurance contract is missing. However, receiving a notification does not automatically confirm a violation of the law.
Mandatory Employee Accident Insurance: Legal Requirements
Under the legislation of the Republic of Kazakhstan, employers are required to insure their employees against accidents occurring in the course of their employment (official) duties. To comply with this requirement, employers must conclude a mandatory employee accident insurance contract with an insurance company and monitor its validity period. Employee accident insurance is a mandatory legal requirement, and administrative liability is prescribed by law for failure to conclude the required insurance contract. Therefore, employers should ensure that insurance contracts are concluded and renewed in a timely manner and that the relevant information is kept up to date.
How Notifications Are Generated on the HR Enbek Portal
Notifications concerning mandatory employee accident insurance are generated automatically when the information system does not identify records of a valid insurance contract.
The system uses two main sources of information to generate these notifications:
- Information on active employment contracts registered on the HR Enbek portal.
- Information on mandatory employee accident insurance contracts received from the Unified Insurance Database and integrated with the digital systems of the Ministry of Labor and Social Protection of the Population of Kazakhstan.
If information about a valid insurance contract is missing or does not match the records available in the system, the employer receives a notification. It is important to note that receiving such a notification does not automatically establish a legal violation. The notification is informational in nature and allows the employer to verify employee insurance details and resolve any identified discrepancies, if necessary.
Why Notifications May Be Received Despite Having a Valid Insurance Contract
A notification may appear on the HR Enbek portal even if the employer has already concluded or renewed a mandatory employee accident insurance contract. One possible reason is a delay in updating information within the relevant systems. Details of a newly concluded or renewed contract become available only after the insurance company submits the information and it has been processed. As a result, updates on the HR Enbek portal may not appear immediately. Notifications may also result from discrepancies between insurance contract details and information recorded in government systems. In such cases, employers should verify the contract’s validity, ensure that all relevant employees are covered, and check the accuracy of the submitted information.
What Employers Should Do After Receiving a Notification
The appropriate actions depend on the current status of the mandatory employee accident insurance contract.
- The insurance contract has not been concluded or has expired. The employer should contact an insurance company to conclude a new contract or renew the existing one in accordance with applicable legislation.
- The insurance contract is valid and remains in force. The employer should verify the contract’s validity period, employee insurance coverage, and consistency of the contract details with the information recorded in the relevant systems. If discrepancies are identified, the insurance company should be contacted to clarify and update the information.
- The insurance contract has recently been concluded or renewed. Employers should take into account possible delays in the transmission and processing of information. Updates on the HR Enbek portal may take some time to appear.
- The notification is received repeatedly. It is recommended to contact the insurance company to confirm the status of data transmission and determine whether the insurance contract information needs to be updated. All notifications received are stored in the employer’s personal account on the HR Enbek portal.
Key Considerations for Employers
Notifications concerning mandatory employee accident insurance are primarily intended to inform employers about the need to comply with statutory insurance requirements. They serve an informational and preventive purpose and do not mean that a violation has already been established. Nevertheless, employers should not disregard such notifications. Regularly checking the validity of insurance contracts, their expiration dates, and the accuracy of information in the relevant systems helps identify potential discrepancies in a timely manner. Particular attention should be paid to ensuring consistency between information on active employment contracts and employee insurance coverage. Timely data updates and communication with insurance companies are important for maintaining compliance with mandatory legal requirements.
