What Is Recognized as the Taxpayer’s Location?

The State Revenue Department reminds taxpayers of the importance of correctly determining their location. Although many entrepreneurs consider this a mere formality, a taxpayer’s location plays a crucial role in tax administration and interaction with government authorities. The accuracy of this information affects tax registration, receipt of notifications from state revenue authorities, processing of applications, and determination of the competent tax authority.

What Is a Taxpayer’s Location?

According to Article 11 of the Tax Code of the Republic of Kazakhstan, a taxpayer’s location is determined based on the taxpayer’s status: an individual, individual entrepreneur, legal entity, or non-resident. In practice, the location is the official address used for interaction between the taxpayer and the state.

Location of Individuals

For individuals, the location is recognized as the registered address of a citizen in accordance with the migration legislation of the Republic of Kazakhstan. If a citizen of Kazakhstan permanently resides outside the country and has no valid registration within Kazakhstan, their location is considered to be their last registered address in Kazakhstan. This is important for receiving notifications, fulfilling tax obligations, and interacting with government authorities.

What Is Considered the Location of an Individual Entrepreneur?

For individual entrepreneurs and individuals engaged in private practice, the location is the principal place of business activity specified during tax registration.

In practice, this means entrepreneurs should promptly update their information whenever their actual place of business changes to avoid complications in dealing with tax authorities.

Location of Legal Entities

For resident legal entities of the Republic of Kazakhstan, the location is recognized as the address of the permanent executive management body entered into the National Register of Business Identification Numbers. Government authorities send official correspondence, notifications, and other documents to this address. Special attention should be paid to keeping the legal address up to date. If a company operates from a different address without updating its registration details, it may miss important notifications and face tax-related risks.

Specifics for Foreign Companies and Non-Residents

For non-resident legal entities operating through a permanent establishment without creating a branch or representative office, the location is considered to be the place of business activity in Kazakhstan declared during tax registration. If a company is established under foreign legislation but has its place of effective management in Kazakhstan, its location is recognized as the address of the actual management body specified during tax registration and confirmed by the relevant management decision. For foreign nationals and stateless persons, the location is the temporary place of residence declared during state registration in Kazakhstan.

Why Is It Important to Update Information Promptly?

The accuracy of location data directly affects the quality of interaction with state revenue authorities.

Incorrect information may result in:

  1. failure to receive tax notifications;
  2. missed deadlines for fulfilling obligations;
  3. penalties and late payment charges;
  4. disputes with tax authorities;
  5. difficulties during tax audits.

Therefore, entrepreneurs and company executives should regularly verify the accuracy of their registration data and promptly update it whenever the business address or management location changes.

A taxpayer’s location is not merely a formal detail in registration documents. The accuracy of this information ensures effective communication with government authorities, timely receipt of notifications, and proper fulfillment of tax obligations.

Timely updates of registration information help businesses avoid tax risks, financial penalties, and administrative disputes.
