Kazakhstan is preparing to introduce new rules that will change how employers are monitored for compliance with labor law. The Ministry of Labor and Social Protection has developed a draft order that will bring a risk-based approach to inspections, with the reform expected to take effect in December 2025
What Will Change?
Until now, labor inspections often followed a uniform approach. The new system will classify employers by risk level — low, medium, or high — similar to the way inspections already work in the tax sphere. This means that:
- Companies with a higher risk profile will be inspected more frequently.
- Employers with strong compliance records will face fewer checks.
- The focus will shift from formal procedures to the overall culture of compliance within a company.
Why This Matters
For employers, this reform is not just about new bureaucracy. It represents a shift toward preventing violations before they happen. Authorities will have better tools to identify companies that systematically ignore labor rights, while responsible businesses will benefit from reduced administrative pressure.
For employees, the changes are aimed at ensuring that rights to fair pay, safe working conditions, and proper contracts are respected across the board.
Preparing for 2025
Businesses in Kazakhstan should start reviewing their internal policies now. Clear employment contracts, transparent payroll practices, and proper occupational safety measures will be critical in avoiding a high-risk rating. In practice, the reform encourages employers to integrate compliance into daily operations, rather than treat it as a one-off requirement during inspections.
Looking Ahead
The draft order is currently open for public discussion until September 23, 2025. Once adopted, the new system is expected to make labor inspections more targeted, fair, and effective. For companies, it is both a challenge and an opportunity: those who invest in compliance will strengthen their reputation and reduce regulatory risks, while those who cut corners may face increased scrutiny.
