New Rules for Digital Condominiums in Kazakhstan
Kazakhstan has approved new rules governing the establishment and operation of digital condominiums. The Rules for the Establishment, Operation, Registration, and Termination of Digital Condominiums were approved by Order No. 373/NK of the Deputy Prime Minister – Minister of Artificial Intelligence and Digital Development of the Republic of Kazakhstan, dated July 2, 2026. The Order entered into force on July 12, 2026, establishing a unified procedure for the creation, registration, management, and termination of digital condominiums.
What is a Digital Condominium?
A digital condominium is a form of joint ownership in which several participants jointly own, use, and manage digital assets (elements of the digital environment) according to predefined rules. Participants may jointly use and dispose of digital assets and make decisions in accordance with the terms of an agreement or a smart contract that automatically executes the agreed conditions.
How is a Digital Condominium Established?
A digital condominium may be established based on:
- ~ an agreement between the participants;
- ~ a smart contract providing for the automatic execution of agreed conditions.
Both individuals and legal entities may become participants. Participants may either manage the condominium themselves or appoint an authorized representative responsible for managing the condominium and performing the functions established by the Rules.
Management of Digital Assets
Any operation involving digital assets is initiated at the request of one of the participants. Such actions are carried out:
- ~ after confirmation by the other participants; or
- ~ automatically upon the occurrence of conditions specified in the smart contract.
All actions, changes of rights, and other transactions must be recorded within the digital environment to ensure transparency and enable subsequent verification.
State Registration of Digital Condominiums
The registration of digital condominiums is maintained by the authorized state body responsible for digitalization. The authorized representative of the condominium must submit information to the state register within five working days in the event of:
- establishment of a digital condominium;
- amendments or changes;
- termination of its activities.
Grounds for Termination
A digital condominium may be terminated in the following cases:
- by decision of the participants;
- upon the occurrence of conditions specified in the agreement or smart contract;
- by a court decision.
Upon termination, the participants independently determine how the rights to the digital assets will be distributed unless another procedure is established by the agreement or applicable legislation.
